These Terms & Conditions ("Terms") govern your access to and use of this website and the booking of any New Year celebration experience, package, ticket or add-on ("Package(s)") offered by Dubai New Year Celebrations ("we", "us", "our", "the Company"). By submitting a booking request, completing a booking, or otherwise using this website, you ("you", "the Guest", "the Lead Booker") confirm that you have read, understood and agree to be bound by these Terms on your own behalf and on behalf of every person included in your booking.
Cancellation Policy — All New Year Packages
All New Year Packages are strictly non-refundable. Once a Package is booked and confirmed, it cannot be cancelled, refunded, rescheduled, transferred to another date, or exchanged for any other Package or credit, for any reason. A 100% cancellation fee applies to every cancellation, no-show, late arrival or missed departure. This applies regardless of when the cancellation request is made relative to the event date.
1. About Us & These Terms
Dubai New Year Celebrations is a booking and concierge service that markets and arranges New Year's Eve experiences in Dubai, including but not limited to dhow cruises, catamaran cruises, yacht parties, observatory tickets and related dining, entertainment and transfer services. Some experiences are operated by us and some are operated by independent third-party operators, vessel owners or venues (each an "Operator"). These Terms apply to all bookings made through us. Where an Operator imposes its own additional terms, conditions or house rules, those apply in addition to these Terms, and where there is a conflict the stricter provision prevails.
2. Definitions
- "Package" — any experience, cruise, ticket, event entry, dining package, deck or seating category, or add-on offered or booked through us.
- "Booking" — a confirmed reservation for one or more Packages for which we have issued a confirmation and/or ticket.
- "Lead Booker" — the person who makes the booking and who is responsible for the full booking, all payments and all guests within it.
- "Event Date" — the date of the New Year celebration to which the Package relates (typically 31 December).
- "Booking Request" — an enquiry or request submitted via the website form, which does not constitute a confirmed Booking until we accept it and issue confirmation.
3. Bookings & Confirmation
- A Booking Request submitted through the website is an offer by you to book. No contract exists until we confirm the Booking in writing (by email, message or voucher) and, where payment is required, payment has been received in full or in the agreed amount.
- We may decline or be unable to accept a Booking Request, for example where a Package is sold out, mispriced, or unavailable. In that case any amount paid for that unfulfilled Booking will be refunded and we will have no further liability.
- The Lead Booker must be at least 21 years old, must provide complete and accurate information for every guest, and is responsible for ensuring all guests are aware of and comply with these Terms.
- Capacity, deck allocation, seating and inclusions are subject to availability at the time the Booking is confirmed.
4. Prices, Payment & Taxes
- All prices are quoted in United Arab Emirates Dirhams (AED) unless stated otherwise and are per person unless stated otherwise.
- Prices are subject to change until a Booking is confirmed. The price applicable to your Booking is the price confirmed to you in writing at the time of confirmation.
- Prices may vary by Event Date, deck or seating category, guest count, and selected add-ons. Optional extras (including transfers, premium beverages, photography and upgrades) are charged in addition to the Package price.
- Applicable taxes, service charges, tourism fees and municipality fees are the Guest's responsibility and may be shown separately or included, as indicated at the time of booking.
- Full payment is required to secure a Booking unless we expressly agree otherwise in writing. Where a deposit is permitted, the balance is due by the date we specify; failure to pay the balance on time entitles us to treat the Booking as cancelled by you, with the cancellation terms in Section 5 applying.
- Card, bank and payment-gateway charges, currency-conversion costs and any chargeback fees are the Guest's responsibility.
5. Cancellations, Changes & Refunds (Guest-Initiated)
- All New Year Packages are non-refundable. Once a Booking is confirmed, it cannot be cancelled by the Guest for any reason and a 100% cancellation fee applies to the full value of the Booking.
- No refund, partial refund, credit note, voucher or transfer of value will be given for cancellations, no-shows, late arrivals, missed departures, unused tickets, unused inclusions, early departure from an event, or a decision not to attend.
- Date changes and rescheduling are not permitted. A request to move a Booking to a different date will be treated as a cancellation of the original Booking (100% fee) and a new Booking at the then-current price, subject to availability.
- Reductions in guest numbers after confirmation are not refundable. Increases are subject to availability and charged at the then-current price.
- Name changes may be permitted at our sole discretion up to 48 hours before the Event Date and may incur an administration fee; they are never guaranteed, particularly where an Operator requires named manifests or QR tickets.
- Bookings are non-transferable and may not be resold, auctioned, or offered as a prize without our prior written consent.
- Any refund we do agree to make, at our discretion or where required by law, will be made to the original payment method within 7–14 working days and net of non-recoverable third-party costs and payment-processing fees.
- Health-related cancellations: requests to cancel for medical reasons are considered only where original, valid medical documentation is submitted before the Event Date and verified by us. We may, at our sole discretion, decline any request that is not supported by adequate evidence or that does not meet this policy. Consideration of a request does not guarantee a refund.
- This Section 5 reflects the fact that New Year's Eve capacity is reserved exclusively for your Booking well in advance and cannot be resold, and applies notwithstanding any general cancellation rights that might otherwise be implied.
6. Cancellation or Changes by the Company / Operator
- We and the Operator reserve the right to cancel, postpone, delay, shorten, re-route or otherwise change any Package where necessary for reasons including unsafe weather or sea conditions; technical, mechanical, safety or operational issues; insufficient participant numbers on shared experiences; regulatory or authority instruction; or force majeure.
- If we cancel a Booking in its entirety before the Event Date for reasons within our control, your sole and exclusive remedy is a refund of the amount you paid for that Booking, or, at our option, a comparable alternative Package or a credit of equivalent value.
- Where an event proceeds but is affected by delay, a shortened duration, a change of vessel, venue, route, menu, entertainment, deck or seating, or by the fireworks not being visible or not taking place, this does not constitute a cancellation and no refund, partial refund or compensation is due.
- We are not liable for any incidental or consequential costs you incur in connection with a cancellation or change, including flights, accommodation, ground transport, visa costs, other bookings, or third-party services.
- Notice of cancellation or a material change will be given as soon as reasonably practicable by email, phone or SMS, and/or via the platform through which the Booking was made. It is your responsibility to provide accurate contact details and to monitor them in the days before the Event Date.
7. Tickets, Vouchers & Boarding
- Your confirmation, voucher or QR ticket must be presented (digitally or printed) at boarding or entry, together with valid photo identification for each guest.
- The confirmed boarding point, meeting point and sailing schedule may be issued on your QR ticket or communicated separately, typically one to two days before the Event Date.
- Tickets are void if altered, duplicated, damaged so as to be unreadable, or obtained from an unauthorised reseller.
- Guests must remain in the deck, room, seating area or zone assigned at the time of booking. Wristbands or tags may be used to identify access privileges and must be worn for the duration of the event.
8. Arrival, Timings & No-Shows
- Guests must arrive at the boarding or meeting point by the stated time, and in any event at least 15 minutes before departure unless a longer period is specified.
- Vessels and events depart and begin at the scheduled time and will not wait for late guests. New Year's Eve road closures and congestion are foreseeable; you must allow substantial extra travel time.
- Guests who arrive late, miss the departure, go to the wrong location, or fail to attend are treated as no-shows and are not entitled to any refund, alternative date or compensation.
- Stated durations are approximate and include boarding and disembarkation time.
9. Identification & Entry Requirements
- Every guest must carry a valid original Emirates ID or passport for verification at boarding or entry. Copies may not be accepted.
- Entry may be refused, without refund, to any guest who cannot provide acceptable identification or who does not meet the age requirements for the Package or for alcohol service.
- Guests are responsible for holding any visas, permits or travel documents required for their presence in the UAE.
10. Guest Conduct & Right to Refuse
- Guests must comply with all instructions from crew, security, hosts and venue staff, with all safety briefings, and with UAE law and local customs, including dress codes and rules on public behaviour.
- We and the Operator may refuse boarding or entry to, or remove from the vessel or venue, any guest who is intoxicated, under the influence of illegal substances, behaving in a manner that is abusive, threatening, unsafe, disorderly or disruptive, or who is reasonably suspected of doing so or intending to do so.
- No refund, alternative or compensation is due to any guest refused boarding or removed for these reasons, and any onward transfer or transport for that guest is at their own cost and risk.
- Outside food and beverages are not permitted. Prohibited items include but are not limited to weapons, illegal substances, fireworks, flares, glass containers not provided by the Operator, and drones.
- Guests are liable for any loss or damage they cause to the vessel, venue, equipment or property of the Company, the Operator or other guests, and authorise us to charge the cost of repair or replacement to their payment method.
- Smoking, including e-cigarettes and vaping, is only permitted in designated areas where provided.
11. Health, Safety & Special Requirements
- Guests must be in a fit state to participate. Guests who are pregnant, have reduced mobility, heart conditions, or other medical conditions, and guests requiring accessibility assistance, must notify us in writing before booking so we can advise whether the Package is suitable. Not all vessels or venues are accessible.
- Food and beverage inclusions may contain or be prepared alongside allergens (including nuts, shellfish, dairy, gluten and egg). We cannot guarantee an allergen-free environment. Guests with allergies or dietary needs must inform us in advance and remain responsible for their own choices on board.
- Guests participate in all activities, including any optional elements such as an edge walk or open-deck areas, at their own risk and must follow all safety instructions.
- Guests must not enter the water, climb on railings or restricted structures, or interfere with vessel equipment.
12. Children & Minors
- Child and infant pricing and age bands are as stated on the relevant Package page. Where a child ticket applies to a given age band, a valid ticket must be purchased for each child in that band.
- Children and minors must be accompanied and supervised at all times by a parent or legal guardian, who is fully responsible for their safety and conduct.
- Some experiences are primarily adult-oriented; suitability information on the Package page should be reviewed before booking.
13. Alcohol
- Where a Package includes alcohol, service is limited to guests aged 21 or over on production of valid photo identification. The Operator may refuse service at its discretion, including to guests who appear intoxicated.
- Alcohol packages, where offered, typically comprise house wine and beer unless stated otherwise. No refund is due for alcohol not consumed.
- Certain family-oriented experiences do not permit alcohol; this is stated on the relevant Package page.
14. Transfers & Pick-Ups
- Transfers are optional and available only where offered for the relevant Package, from hotels and residences within the stated service area. Airport pick-up and drop-off are not provided unless expressly stated.
- Pick-up and drop-off times are indicative and may shift, often by 30–60 minutes or more, due to New Year's Eve traffic, road closures and consolidated routing. Pick-up or drop-off may not be possible for some locations, particularly after road closures take effect in the late afternoon or evening.
- Guests who miss their transfer pick-up window must make their own way to the boarding point at their own cost; this does not entitle the guest to any refund.
- Where a guest selects "direct reporting" / no transfer, travel to and from the boarding point is entirely the guest's responsibility.
15. Changes to Itinerary, Vessel & Route
- Routes, sailing areas, vessels, venues, menus, beverage selections, entertainment line-ups, viewing positions and timings are indicative and may change without notice for operational, safety, licensing, capacity or authority reasons.
- Fireworks displays are organised by third parties and public authorities. Their occurrence, timing, location, duration and visibility are outside our control. A Package is not sold on the basis of any guaranteed fireworks view, and no refund or compensation is due if fireworks are cancelled, curtailed, relocated or obscured.
- The coast guard or other authorities may restrict open-water sailing; in that case the vessel may operate a modified route or remain closer to shore.
16. Weather & Sea Conditions
Events proceed in a wide range of weather. The Company or the captain may delay, shorten, re-route, reschedule or cancel a sailing where weather or sea conditions present a safety risk, and their decision is final. Where an event still takes place, adverse weather, reduced visibility, temperature, wind or swell do not entitle any guest to a refund or compensation. Guests are advised to dress appropriately and to bring a light jacket.
17. Force Majeure
We are not liable for any failure or delay in performing our obligations where caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic, government or authority action, restrictions or advisories, changes to or cancellation of public events and fireworks, civil unrest, terrorism, strikes or labour disputes, utility or infrastructure failure, port or marina closure, and Operator insolvency. Where a Package is prevented, curtailed or materially affected by a force majeure event, our liability is limited to a refund of the recoverable portion of the amount paid, at our discretion, after deduction of non-recoverable third-party costs.
18. Third-Party Operators
Where a Package is delivered by an Operator, that Operator is responsible for the operation and safety of the experience and for the vessel, venue, crew, catering and entertainment. We act as a booking agent and concierge in respect of those Packages. Our liability in respect of Operator-delivered Packages is limited to the exercise of reasonable care in arranging the Booking, and, to the maximum extent permitted by law, we are not liable for the acts, omissions, negligence or default of any Operator or its staff.
19. Photography & Marketing
- Events may be photographed or filmed by us or the Operator for security and promotional purposes. By attending, guests consent to appearing in such images and to our use of them across marketing channels without payment. Guests who do not wish to be featured should notify staff on the day.
- Guests must not photograph or film other guests or staff without consent, and must not use any commercial photography, drone or live-broadcasting equipment on board without prior written permission.
20. Limitation of Liability
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our proven negligence, for fraud, or for any liability that cannot lawfully be excluded.
- Subject to the above, we are not liable for indirect, incidental, special or consequential loss, or for loss of enjoyment, loss of opportunity, disappointment, distress, loss of profit, or wasted expenditure (including flights, accommodation, transport, other bookings and time off work).
- Subject to the above, our total aggregate liability to you and all guests in your Booking, whether in contract, tort (including negligence), statute or otherwise, arising out of or in connection with a Booking, is limited to the total amount actually paid by you to us for that Booking.
- We are not responsible for services, facilities or standards that are outside our direct control, or for changes caused by the acts of guests, third parties, Operators or authorities.
21. Indemnity
The Lead Booker agrees to indemnify and hold harmless the Company, its officers, employees and Operators against all claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with any breach of these Terms by the Lead Booker or any guest in the Booking, any act or omission of such guests, or any damage or injury they cause.
22. Insurance
We strongly recommend that all guests hold comprehensive travel insurance covering, among other things, cancellation, curtailment, medical expenses, personal accident and personal belongings. As New Year Packages are non-refundable, travel insurance is the appropriate route for guests seeking protection against being unable to attend.
23. Personal Belongings
Guests are responsible for their own belongings at all times. Neither the Company nor the Operator accepts liability for loss of, or damage to, personal property brought to an event, except where caused by our proven negligence. Large luggage is not permitted on board.
24. Website Use & Intellectual Property
- All content on this website — text, graphics, logos, images, layout and code — is owned by or licensed to the Company and is protected by intellectual property laws. You may not copy, reproduce, republish, scrape, or use it for commercial purposes without our prior written consent.
- You must not use the website in any way that is unlawful, fraudulent, or harmful, or that interferes with its operation or security, and you must not submit false, misleading or third-party personal information without authority.
- Booking-request forms on the website are for genuine enquiries only. We may refuse or cancel bookings we reasonably believe to be fraudulent, speculative, automated or made in bad faith.
25. Pricing Errors & Website Accuracy
We take care to describe and price Packages accurately, but the website may occasionally contain errors, inaccuracies or omissions relating to price, description, inclusions, availability or timings, and content may be out of date. We reserve the right to correct any error and to cancel any Booking affected by an obvious error (including an obvious mispricing), even after confirmation, in which case we will refund any amount paid for that Booking and have no further liability.
26. Complaints
If you are dissatisfied during an event, you must raise it immediately with the crew, host or venue staff so they have the opportunity to address it at the time. Any complaint that cannot be resolved on the day must be submitted to us in writing at info@newyearcelebrationdubai.com within 14 days of the Event Date, with your booking reference and supporting detail. Complaints raised after this period, or not first raised on the day, may not be considered.
27. Privacy
Personal information collected in connection with your Booking is handled in accordance with our Privacy Policy, which forms part of these Terms.
28. General
- Entire agreement: these Terms, together with the Package details confirmed to you and our Privacy Policy, form the entire agreement between you and us and supersede any prior discussions, representations or marketing statements.
- No reliance: you have not relied on any statement or representation not expressly set out in these Terms or your booking confirmation.
- Severability: if any provision is found unenforceable, the remaining provisions continue in full force, and the unenforceable provision is replaced by an enforceable one that best reflects its intent.
- No waiver: any delay or failure by us to enforce a provision is not a waiver of our right to do so later.
- Assignment: you may not assign or transfer your rights under a Booking. We may assign our rights and obligations to an affiliate or successor.
- No third-party rights: no person other than you and us has any right to enforce these Terms, save that Operators may rely on the exclusions and limitations that benefit them.
- Notices: notices to you may be sent to the email or phone number on your Booking; notices to us must be sent to the contact address below.
- Language: these Terms are drafted in English, which is the governing language of the agreement.
29. Governing Law & Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, a Booking, or the use of this website (including non-contractual disputes) are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. The courts of Dubai, UAE, have exclusive jurisdiction, and you submit to that jurisdiction.
30. Changes to These Terms
We may update these Terms from time to time. The version in force at the time you make a Booking is the version that applies to that Booking. The "Last updated" date at the top of this page shows when the current version took effect. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
